These are Cibaria International's online store terms and conditions of use to which all online purchases are subject. We reserve the right to change these terms and conditions at any time, without notice. Any changes will take effect when posted on this website. By using this website you agree to be bound by these Terms and Conditions.

Your privacy is important, and your information will never be shared with third-party entities. Please see our Privacy Policy for details of what information we collect and how we will use and protect it.

Ordering Goods

Our online store can only accept orders originating from and for delivery to the United States. Cibaria will confirm receipt of your order by sending an email to you, using the address you supplied when ordering on our website. This email is an acknowledgement and does not constitute legal acceptance by us of your order. You are responsible for ensuring the accuracy of the terms of any order you submit. All orders placed on the Cibaria online store are subject to stock availability. No contract will exist until payment has been received. This will be deemed to be our acceptance of your order and to have been effectively communicated to you. Please note that the only language in which the contract can be concluded is English. We reserve the right not to accept any order.

The representation of colors on your browser may vary from the actual colors. Products are not scale models (except where stated in individual product descriptions).

Any advice and/or recommendations given on this website or otherwise given to you by us, or any of our employees or agents, should be followed or acted upon at your own risk. We shall not be liable for such advice and/or recommendations. Product images are reproduced with the consent of the owner or license holder of the copyrights and trademarks in such products.

Pricing

Every effort is made to ensure that our prices and descriptions are accurate, If an administrative error has resulted in an incorrect price being displayed we reserve the right to correct that price and notify you accordingly. In these circumstances, you will not be bound to continue your purchase. You will be asked to email us to confirm that you choose to proceed at the correct price, however, if you decide not to continue with the purchase, your monies will be refunded to your credit card in full. The repayment of such monies paid to us will be the extent of our liability to you in the event
of pricing errors.

Price list, catalogs, and other advertising literature or material used by Cibaria International are intended only as an indication as to price and range of goods offered and no prices, descriptions or other particulars contained therein shall be binding on our online store. Any promotional prices for specific marketing or manufacture's programs shall be available to those qualifying customers at the time of the order.

We reserve the right to change the prices at any time. However, if we accept an order from you, the price will remain the same as the price set out on the relevant page at the time the order is placed.

Payment

We accept payment by most major credit cards registered with U.S. addresses. We do not accept cash, personal checks, money orders or ship COD. Upon providing us with details of your chosen payment card and submitting an order, you confirm that you are authorized to use the payment card to pay for the goods on the order and authorize us to deduct from the payment card the full price of the goods and all other payments due such as delivery charges. Payments are to be made in full at the time the Customer places an order.

Shipment

Your order will be delivered to the address listed on the order and can only be shipped within the United States. While every effort is made to deliver the order in accordance with the timescales set out, we do not accept any liability for any delay in delivering the order due to events or circumstances beyond our reasonable control or for any business losses. Check your order immediately upon receipt.

Cancellation and Returns

 ALWAYS INSPECT YOUR SHIPMENT IMMEDIATELY UPON RECEIPT FOR ANY DAMAGES.

 If your order is damaged take a photo immediately and contact customer service. Please include photos to assist in filling for damage claims.

Customer return requests must be authorized according to our Bio-Terrorism policies and a 15% restocking fee will apply. Product Return Requests must be made within 30 days of ship date.  Product Return Requests made after 30 days of ship date will not be accepted.  Please note:  Private Label and Custom-made products may not be returned.

The Bio-Terrorism policy states any product being returned to our facility from a customer must be in its original container with the original product seals still intact.  The procedures must be followed before a credit may be issued.

A copy of the CRPA must be included with the return load for it to be accepted into our facility.

All trademarks, copyright, database rights and other intellectual property rights in the materials on this website, as well as the organization and layout of this website, together with the underlying software code are owned either directly by us or our licensors

Law and Jurisdiction

This notice is governed by and construed in accordance with U.S. law, and any disputes relating to this notice shall be subject to the jurisdiction of the courts of California. No claim is made by Cibaria International nor any claim in relation to any of the products available for purchase online to diagnose, cure or prevent any specific disease or condition. It is the responsibility of the purchaser to decide if the product would benefit them or not.

Enforcement

If we fail to enforce any of these conditions, that does not mean that we have waived any of our rights and we retain the right to enforce any of these conditions at any time.
